A booking is not considered confirmed until a signed contract and the required retainer fee are received. Retainer fees are non-refundable and secure the date exclusively for the client.
Remaining balances, payment schedules, and accepted payment methods are detailed in the client’s contract. Failure to submit payments on time may result in suspension or cancellation of services.
For events outside the Photographer’s local service area or outside Florida, clients are responsible for all agreed-upon travel-related expenses. These may include airfare, accommodations, transportation, meals, and additional coverage days, as specified in the contract.
By booking, the client acknowledges familiarity with the Photographer’s portfolio and artistic style. Editing, curation, and delivery are performed at the Photographer’s creative discretion.
Specific shots or poses are not guaranteed, as photography is influenced by timing, lighting, weather, venue restrictions, and guest cooperation.
All images remain the intellectual property of the Photographer and are protected by U.S. copyright law.
Clients are granted a personal-use license to print and share images for non-commercial purposes. Images may not be altered, sold, or used for commercial purposes without written permission.
The Photographer reserves the right to use images for portfolio, website, social media, marketing, publication, and promotional purposes unless otherwise agreed to in writing.
All content on this website, including images, text, logos, and design elements, is the property of Tracy Townsend Photography and may not be copied, reproduced, or distributed without written consent.

While every effort is made to deliver high-quality services, the Photographer is not liable for circumstances beyond reasonable control, including but not limited to weather conditions, venue restrictions, guest interference, equipment failure, or acts of nature.
In the unlikely event of a total failure to perform services due to illness, emergency, or other unforeseen circumstances, any refund shall apply only if expressly stated and agreed upon in a mutually signed contract for that specific project.
Clients are responsible for obtaining permissions, permits, or approvals required by venues or locations.
Clients agree to ensure a safe working environment and to inform the Photographer of any restrictions, schedules, or special considerations in advance.
Cancellation and rescheduling policies are outlined in the signed contract. Retainer fees are non-refundable. Any date changes are subject to availability and may incur additional fees.
These Terms shall be governed and interpreted in accordance with the laws of the State of Florida, without regard to conflict of law principles.
We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on this website.
